Arkansas Governor Sarah Huckabee Sanders signed House Bill 1652 (HB 1652) into law, updating the way in which self-storage operators handle non-monetary tenant defaults. It also addresses the enforceability of unsigned rental agreements and better defines the state’s lien law. HB 1652 take effect 90 days after the legislative session concludes, according to an April 28 email newsletter sent from the national Self Storage Association (SSA) to its members.
Supported by the SSA and the Arkansas Self Storage Association (ARSSA), HB 1652 amends Arkansas Code 18-16-401. Under the measure, tenants can be denied access following a written or electronic notice of termination or nonrenewal of the rental agreement. Operators must send a vacate notification via hand delivery or mail at least 14 days in advance. HB 1652 states a tenant’s belongings can be sold to satisfy the lien if the occupant is in default and the tenant is also required to disclose any lienholders with an interest in the personal property stored in the space. Finally, it states that customers who’ve rented a self-storage unit for at least 30 days automatically accept the terms of the rental agreement even if they haven’t signed it.

A similar measure was signed into law in Tennessee earlier this month.
ARSSA provides education, legal and other industry information, and support for self-storage operators across Arkansas.
The SSA represents more than 22,000 U.S. and international member-affiliated self-storage facilities, according to its website. It’s allied with several state and international self-storage associations and has about 6,000 members.
