Delaware Governor Matt Meyer signed Senate Bill 151 (SB 151) into law on July 30, updating the Delaware Self-Service Storage Facilities Act, which impacts self-storage operators in the state. The legislation took effective immediately. It addresses unsigned rental agreements and nonmonetary defaults. It also updates the way facility operators handle vehicles under lien, allowing them to be removed from the property, according to an Aug. 12 newsletter sent from the national Self-Storage Association (SSA) to its members.

SB 151 clarifies that self-storage rental agreements may be delivered and accepted electronically. Borrowing language from the Delaware Residential Landlord Tenant Act, the bill binds the tenant to the stipulations outlined in the rental agreement, even if the document goes unsigned, as long as they pay rent and use the space for more than 30 days.

The law also clarified the self-storage lien process, allowing operators to advertise on websites that regularly promote property for auction or sale.

Finally, SB 151 updates liens involving a motor vehicle, trailer or watercraft. Operators now have the right to tow these items after the tenant is in default for 60 consecutive days.

The SSA represents more than 22,000 U.S. and international member-affiliated self-storage facilities, according to its website. It’s allied with several state and international self-storage associations and has about 6,000 members.
