The national Self Storage Association (SSA) revealed its legislative agenda for the year and its plans to work with state associations to pursue amendments to industry laws in 22 states. The work-in-progress legislation aims to reduce costs, streamline operations and limit liability for facility owners and managers, focusing on seven core changes in states that haven’t yet adopted them, according to a press release.

Amendments the SSA is seeking in 2025 are:

  • In 15 states, allowing storage operators to advertise through auction websites such as Facebook Marketplace

  • In Ohio and New Mexico, formally recognizing the clause in a rental agreement that limits the property value for stored goods, typically to $5,000

  • In Arkansas, Maine and New York, allowing operators to conduct lien sales online while still offering onsite auctions

  • In New York, giving storage operators the option to tow trailers, vehicles and watercraft that are left in a delinquent space or unit instead of selling them

The SSA also intends to seek amendments relating to rental agreements and nonmonetary defaults. They include:

  • Allowing owners in several states to enforce a new rental agreement, even if it goes unsigned, so long as the tenant continues using the space or paying rent

  • Addressing nonmonetary defaults in several states, allowing operators to dispose of or sell property in the unit after a set number of days following a termination or nonrenewal notice

  • Clarifying laws in eight states to confirm that electronic delivery and acceptance of self-storage rental agreements is permissible

  • Allowing operators in Delaware, Iowa, Michigan, Oklahoma and Pennsylvania to tow titled property for nonmonetary defaults, such as storing the vehicle in an inoperable state

In addition to supporting the above legislation, the SSA will work to block proposals that would restrict or reduce self-storage operators’ rights. These include measures that have been introduced in Montana, Virginia and Washington.

The SSA represents about 22,000 U.S. and international member-affiliated self-storage facilities, according to its website. It’s allied with several state and international self-storage associations and has about 6,000 members.
